Terms and Conditions as of Sep 2022

Warranty Conditions:  

All our installations come with 24 months warranty on parts and 12 Months warranty on Labor from the date of completion. Unauthorized interference with the system shall invalidate this warranty.

As per requirements of The NZ Insurance Council and the NZSA – New Zealand Security Association and manufacturer's recommendations, security systems should have maintenance service at a minimum of twelve monthly intervals.

The warranty on the labour may be extended to twenty-four months conditional on the client’s completion of the Warranty Registration form provided by BK Security Ltd, terms and conditions apply. 

Internet Connectivity Where supplied goods or services are connected to or provided via an internet connection, the loss or other interference in the product or services operation through internet drop off or poor or blocked internet signal is not covered under warranty.

Firmware Updates:  Some products may from time to time require firmware updates to ensure they operate or function in a certain manner.  Site visits to update will be subject to technician labour charges.

Ownership: BK Security retains ownership over the supplied goods until payment is made in full.

Payment Terms: Payment is due on completion or with seven days unless otherwise stated or arranged before installation. Where an installation proceeds over a month’s end, then progress payments will be charged for work completed and goods purchased that month. The client is responsible for any debt recovery costs, interest on the outstanding debt (at bank overdraft rates) plus any outstanding court costs. Where an account is overdue the client may be placed on altered payment terms or stop supply.

Credit checking may be required by BK Security before works commence and in the case of an individual, a specific Privacy Act authority will be required. Limited liability companies shall be required to complete a trade application for longer credit terms.

Deposit: Bk Security may require a 50% deposit to cover materials and labour before we schedule a job and upon quote acceptance, deposit invoices are due on the day they are sent out   Once the deposit is received, Bk Security will schedule the project start date.

A deposit of 33% may be required for indent goods on acceptance as this required by suppliers when ordering.

Dispute / Issue: BK Security must be given first opportunity to rectify any issue before a third-party involvement. In the event of a dispute then meaningful reasonable negotiation or mediation is the first option. Complaints may be made preferably by email (not by Text or other messaging) so there is a clear auditable trail. Very minor issues may be phoned in.

Privacy: The following information will be collected. Names, contact details, email details and billing information.  The client shall have the right to view and have edited any incorrect information. The information will be retained for as long as the client remains a client along with warranty and maintenance service information. No information will be passed to any third party without the clients written express permission.

Change: These Terms and Conditions can be changed as required. If any of the terms or conditions of this contract is held to be invalid or unenforceable then such term or condition or terms or conditions shall be deemed to be severed from the remaining terms and conditions and the remaining terms and conditions shall remain in full force and effect. The Consumer Guarantees Act and Fair-Trading Act shall apply to any goods purchased for non-business activities.

Intellectual Property: Any intellectual property created by for this or any other job BK Security Ltd remains the property of BK Security Ltd

Monitoring Agreements: As monitoring payment is monthly in advance cancellation after the signed term is completed must be in writing - email acceptable, with one months’ notice.

Quotations: Quotations are valid for thirty days unless otherwise another term is expressly noted.  Quotations are based on supplier pricing, freight charges and exchange rates as of the day the quotation is prepared. BK Security Limited reserves the right to adjust pricing should these factors change between the date of the quotation and the date that the product is ordered. Prices are exclusive of GST and freight.

Pricing: Price for Goods and Services: Prices given are exclusive of GST and other applicable taxes. Where goods are sourced from overseas or are special order items, any rise in supplier pricing or increase in tariff will be passed on. This apples to any price rises announced or advised between quotation accepted and commencement of works. Some of the equipment we use. is sourced from United States based companies and where any government tariffs are applied or increased these tariff charges will be passed on. Price fluctuations can be countered by the client paying for the equipment, in full, in advance providing there is no price increase between ordering and delivery receipt.

Variations:  Variations will be charged for on the basis of additions to Bk Security’s quotation and will be detailed in writing and as shown as variations on Bk Security’s invoice.  The client shall respond to any variation submitted by Bk Security within ten (10) working days.  Failure to do so will entitle Bk Security to add the cost of the variation to the original price.  Payment for variations must be made in full at the time of their completion.

Risk: All risk of loss or damage in or in relation to goods shall pass to you upon delivery to your site.

Standard Exclusions: (unless specifically included) Access Equipment, undisclosed or undiscovered construction that prevents or hinders cabling, required specialised equipment, Fire Penetrations, Fire Stopping, and related Compliance & Forms, Parking Charges.

Health and Safety: You must adopt and comply with all health and safety legislation and applicable codes of practice in respect of premises which BK Security Ltd agents, employees or officers are required to access for purposes of Goods installation or services. You must draw to the attention of BK Security Ltd and its agents, employees and officers your own health and safety policies if relevant to their access to your premises.

PSPA

a) The Purchaser agrees to grant a purchase money security interest (“PMSI”) in terms of the Personal Property Securities Act 1999 (“PPSA”) from time to time to the Supplier to secure payments of the purchase price for Goods sold to the Purchaser by the Supplier.

(b) The Purchaser agrees to provide such information, do such acts and execute such further documents as in the Supplier’s opinion is necessary or desirable to enable the company to perfect a PMSI or other security interest under the PPSA.

(c) The Supplier may do all things which it thinks desirable to remedy any default by the Purchaser or otherwise to protect the Goods or the PMSI created by this agreement.

(d) The Purchaser agrees that nothing in sections 114(1) (a), 133 and 134 of the PPSA shall apply to this agreement or the security created pursuant to this agreement. The Purchaser also agrees that none of the Purchaser’s rights as debtor under s116, 119, 120(2), 121, 125, 126, 127, 129, 131 and 132 of the PPSA shall apply to this agreement.

(e) The Purchaser waives its rights to receive a verification statement confirming registration of a financing statement or financing change statement relating to any PMSI or other security interest created by this agreement.

(f) The Purchaser agrees that where the Supplier has rights in addition to those in Part 9 of the PPSA, those rights will continue to apply.

(g) If the Purchaser decides to change its name (legal, business or trading) the Purchaser agrees to inform the Supplier at least 7 days before the change of name becomes effective.

(h) The Purchaser agrees it will not allow or permit the creation of any lien over any of the Goods.
